Terms of Service
📌 By placing an order with Ace Graphics, you confirm that you have read, understood, and agreed to the following Terms of Service.
Ace Graphics is an independent graphic design studio owned and operated by Ace Phoenix. Clients hire Ace Graphics as a studio, and Ace Graphics manages client communication, creative direction, quality control, and delivery. We are not affiliated with Roblox Corporation.
1. Orders & Scope
- Before work begins, the Client and Ace Graphics will agree on the deliverables, price, general creative direction, turnaround time, and revision terms. Confirmation through our official communication channels, including Discord and other social media platforms, may be used as confirmation of an order.
- The Client must provide a clear brief, usable references, and any required game assets or materials before work can begin.
- New concepts, additional thumbnails, major changes in creative direction, replacement briefs, or requests outside the originally agreed scope may require additional payment and a revised deadline.
- Anyone placing an order confirms that they are authorised to approve the purchase for themselves or for the studio, team, group, or project they represent.
- Ace Graphics reserves the right to decline any request or order for any reason.
- If you would like to order something that is not listed in our available services, you may create a ticket or contact us to discuss availability and pricing.
2. Payment Policy
- Unless otherwise agreed, payment is required in full upfront before work begins.
- Accepted payment methods include: Robux, PayPal, Cash App.
- Robux payments are accepted under the agreed payment requirements. If paying with Robux, the Client is responsible for covering any Roblox transaction tax or deductions so that the agreed amount is received.
- Friends, third parties, or other individuals may not make payments on behalf of the Client unless specifically approved beforehand.
- Split payments are accepted only when approved in advance. An order is not considered fully paid until every agreed payment has been received.
- Final files and applicable usage rights may be withheld until payment has been fully received and cleared.
- PayPal invoices are not provided.
- If the Client believes a charge or payment amount is incorrect, they should contact Ace Graphics first so the issue can be reviewed and resolved.
3. Priority Service
- Priority service means your order will be placed ahead of regular orders and worked on first based on availability.
- Priority service will require an additional cost.
- Priority service does not automatically guarantee same-day delivery unless a specific deadline has been discussed and agreed upon beforehand.
4. Turnaround Time & Deadlines
- Turnaround time depends on the type, complexity, and requirements of the order.
- The estimated turnaround time will be discussed before work begins. Turnaround starts only after full or agreed payment has been received, the Client has provided a complete brief, and all required assets and materials have been received.
- Deadlines must be discussed and agreed upon beforehand. Ace Graphics cannot guarantee same-day delivery without prior agreement.
- All deadlines depend on the Client providing required payments, assets, information, feedback, and approvals within a reasonable timeframe. If the Client causes or contributes to a delay, the original deadline may no longer apply. Ace Graphics will provide a revised estimate based on current availability.
- Unless a new deadline is expressly agreed upon, Ace Graphics is not responsible for missing the original deadline due to Client delays or missing information.
- Unexpected delays on our side will be communicated as early as reasonably possible.
- Please do not excessively rush or pressure the artist. Progress updates will be provided throughout the order when reasonably necessary.
5. Delivery
- Completed work will be delivered electronically in the agreed format.
- The Client is responsible for saving and keeping copies of all delivered files. Ace Graphics does not guarantee permanent storage of completed project files.
- Unless otherwise agreed, source files, working files, templates, PSD files, and .blend files are not included with a standard order.
- Requests for both the PSD/source file and .blend file may require an additional cost.
- Rejected concepts, drafts, templates, and other working files remain the property of Ace Graphics unless otherwise agreed.
6. Revisions
- Each order includes up to three (3) revisions, unless otherwise stated in the order agreement.
- Revisions are intended to refine the originally agreed creative direction. Revisions do not include an entirely new concept, a replacement brief, major changes to the original direction, additional thumbnails or designs, or requests outside the agreed scope.
- Feedback should be clear, specific, and submitted together whenever possible.
- Excessive, repetitive, contradictory, piecemeal, or scope-changing revision requests may require an additional fee and/or revised deadline. The Client will be notified of any additional charge before that work begins.
- Revision requests should be submitted within seven (7) calendar days of receiving the relevant proof or final delivery. Requests made after this period may be treated as a new order.
7. Cancellations & Refunds
- Payments become non-refundable once work has started, except where otherwise required by applicable law.
- A change of mind does not qualify for a refund after work has begun.
- If the Client cancels before work begins, Ace Graphics may provide a refund minus any non-refundable payment processor fees or costs already committed to the order.
- If Ace Graphics cancels an order before work begins, a full refund will be provided.
- If Ace Graphics is unable to complete work already in progress, we may offer a reasonable replacement, a revised delivery date, completion by another trusted artist with the Client's approval where appropriate, or a proportional refund for any undelivered work.
- Nothing in these Terms removes any refund or consumer rights that cannot legally be excluded.
8. Client Responsibilities
- The Client confirms that they own or have permission to use all materials supplied to Ace Graphics, including but not limited to logos, characters, renders, game assets, fonts, images, names, and other intellectual property or materials.
- The Client is responsible for the accuracy and legality of the materials, instructions, and information they provide.
- Ace Graphics is not responsible for infringement or other claims caused by Client-supplied materials or instructions, except where caused by our own unauthorised changes or wrongful conduct.
- The Client must not request that Ace Graphics directly copy another artist's work, impersonate another artist, individual, or brand, infringe intellectual property rights, or create unlawful or seriously misleading content.
- References are used to communicate general direction and inspiration only. Providing a reference does not authorise the direct duplication of another person's work.
9. Usage Rights & Ownership
- After full payment has been received, the Client receives a perpetual commercial licence to use and display the final approved artwork for the game, project, channel, or purpose it was commissioned for, including directly related promotion.
- Routine resizing and cropping for these intended uses is permitted.
- Copyright and ownership of the artwork remain with Ace Graphics, unless otherwise agreed in writing.
- The Client may not claim that they created the artwork, resell the artwork as a standalone asset, redistribute the artwork as a standalone asset, sublicense the artwork, convert the artwork into templates or stock resources, use the artwork for unrelated projects without permission, or claim, resell, or redistribute the work as their own original creation.
- Ace Graphics will not resell the same final custom artwork to another client.
- Credit to Ace Graphics is required when the work is publicly shared, unless the Client requests otherwise and an alternative agreement is made.
- Ace Graphics may display completed work in portfolios, social media, and promotional material after the relevant project has been made public. The Client may request confidentiality or a portfolio delay before work begins.
10. Analytics & Results
- Where included in a service or project, Ace Graphics may review thumbnail or project analytics and use the results to guide future creative decisions.
- The Client must provide accurate data where reasonably required for such reviews.
- Ace Graphics does not guarantee any specific results, including click-through rate, views, revenue, player count, sales, engagement, or performance on any platform.
- Results may be affected by factors outside our control, including the game or content itself, audience, title, traffic source, competition, platform changes, and other external factors.
11. Communication & Inactivity
- Discord and other official Ace Graphics social media platforms are our primary communication channels.
- Important matters such as approvals, revisions, cancellations, and major scope changes should be recorded through an official communication channel.
- If the Client does not respond or provide required materials, information, feedback, or approvals, the project schedule may be paused immediately and any previous deadline may cease to apply.
- After three (3) consecutive days without a required response, and after a reasonable attempt to contact the Client, the project may be considered abandoned and closed or archived.
- Amounts already paid may remain non-refundable to cover completed work and reserved capacity.
- Ace Graphics is not obligated to continue or complete an abandoned project unless otherwise agreed.
- Restarting an abandoned project is at Ace Graphics' discretion, depends on current availability, and may require a new quote, additional payment, or revised deadline.
12. Conduct
- Clients must communicate respectfully with Ace Graphics.
- Harassment, threats, abuse, discrimination, misuse of private information, fraudulent payment claims, or other serious misconduct may result in immediate cancellation of the order, refusal of future service, or other appropriate action where necessary.
13. Payment Disputes & Liability
- Before opening a chargeback or payment dispute, the Client should contact Ace Graphics and provide a reasonable opportunity to resolve the issue.
- Knowingly false or fraudulent chargebacks are considered a serious breach of these Terms.
- Where necessary, Ace Graphics may provide payment providers with relevant evidence, including order history, payment records, messages, approvals, revision history, and delivery records.
- Ace Graphics reserves the right to pause or cancel work due to non-payment, abusive conduct, unlawful requests, fraud, or a serious breach of these Terms.
- The Client remains responsible for authorised work that has already been completed.
- To the extent permitted by applicable law, Ace Graphics is not responsible for indirect losses, lost revenue, platform decisions, Roblox moderation actions, or performance outside our reasonable control.
- Our total responsibility for any claim relating to an order will not exceed the amount paid by the Client for the affected order, except where applicable law provides otherwise.
14. Changes to These Terms
- Ace Graphics may update these Terms of Service for future orders at any time.
- Material changes affecting an active ongoing service will be communicated before they take effect where reasonably required.
- By continuing with a new order after updated Terms have been published or provided, the Client agrees to the updated Terms.
15. Agreement
- By placing an order with Ace Graphics, you acknowledge that you have read, understood, and agreed to all of the Terms of Service above.
